Justin Flanagan

Justin is a registered patent attorney that protects the intellectual property of his clients through patent and trademark procurement, licensing, and litigation. He has more than ten years of experience preparing and prosecuting patent applications in the United States and foreign countries. Justin also has significant monetization and licensing experience ranging from drafting basic patent assignments and trademark licenses to negotiating complex FRAND licenses between standard-setting organizations and Fortune 500 companies.

Justin’s litigation experience includes several multimillion-dollar patent infringement lawsuits, inter partes review proceedings before the USPTO, trade secret disputes, and electrical construction defects in data centers. His practice also encompasses due diligence investigations, product clearance analysis, non-infringement opinions, and invalidity opinions. Justin has been repeatedly selected by his peers as one of Utah’s “Legal Elite” in the category of Intellectual Property (Utah Business Magazine).

Justin is also an adjunct professor at Utah Valley University, most recently teaching "Engineering Law and Patents."

Patent Procurement

  • Personally prepared, prosecuted, and obtained hundreds of patents in the United States and foreign countries for diverse clients and technologies, including consumer electronic devices, 3D-Printers, blockchain technologies, metamaterials, nanotubes, nanofabrication, healthcare, user interfaces, robotics, wireless power transfer, MIMO, synthetic aperture radar, signal processing, ultrasound, radiography, payment processing, semiconductor devices, power distribution and monitoring, energy storage, and electrical infrastructure design.

  • From startup to Fortune 500, Justin has worked with first-time inventors and chief intellectual property officers alike to ensure that patent prosecution strategies are aligned with business objectives.  Justin currently helps manage more than a dozen patent portfolios ranging from just a few pending U.S. patent applications to several hundred worldwide granted patents and pending applications.

  • Patent licenses and sales between startups and university technology transfer offices.

  • Trademark licenses.

  • Pre-litigation counseling for strategic patent procurement.

  • General IP licensing, non-disclosure agreements, employee and independent contract assignment agreements.

Litigation​​

  • Defended multiple clients over the years accused of patent infringement relating to consumer electronic devices, electrical power adaptors, electro-optical devices, ultrasound devices, mechanical bearings, payment processing systems, and software applications.

  • Prepared and filed inter parte reviews in response to patent infringement lawsuits.

  • Represented a client in a highly technical construction defect litigation involving an electrical distribution system in a data center.
